Trump Team Seeks High Court Approval to Dismiss Leading Intellectual Property Official

The ex- leader's administration on Monday petitioned the nation's highest court to allow the removal of the head of the American copyright authority.

This emergency appeal comes roughly a month and a half after a federal appellate court in Washington ruled that the official, Shira Perlmutter, cannot be solely fired.

Nearly one month ago, the full District of Columbia circuit court refused to reconsider that ruling.

This case is the latest in a series of cases concerning executive power to place preferred leaders at government agencies.

The Supreme Court has generally permitted such actions, even as legal challenges proceed.

However, this specific case involves an bureau inside the national library. Perlmutter serves as the copyright registrar and also counsels Congress on copyright issues.

The government's top lawyer, D John Sauer, argued in the filing that, despite ties to Congress, the register “wields administrative power” in overseeing intellectual property rights.

Perlmutter claims she was fired in May because the ex-leader disagreed with advice she provided to Congress in a report concerning artificial intelligence.

She reportedly got an email from the administration informing her that her position was “terminated effective immediately,” as stated by her staff.

A split appeals court group ruled that Perlmutter could keep her position while the case moves forward.

“The Executive's claimed obvious interference with the duties of a congressional official, as she carries out legally authorized responsibilities to advise Congress, strikes us as a breach of the division of government authority,” wrote Justice Florence Pan for the appellate panel.

Judge J Michelle Childs supported the opinion. Both justices were appointed to the appeals court by Democratic leader Joe Biden.

In opposition, Judge Justin Walker, a former president's nominee, wrote that Perlmutter “exercises executive power in a host of manners.”

Perlmutter's attorneys have argued that she is a well-known copyright specialist. She has served as copyright director since former head librarian Carla Hayden appointed her to the position in October 2020.

The ex-leader appointed deputy attorney general Todd Blanche to replace Hayden at the national library. The White House had fired Hayden amid complaints from right-leaning groups that she was promoting a “woke” program.
